Conflicts frequently arise – both in a business and in connection with succession issues. In most cases, the reasons are that the parties have different interests and positions. The issue of succession in particular can crystallise conflicts that have been simmering for a longer time. The consequences are loss of trust and a hardening of fronts. Often, business mediation is the only way to get the parties to work together in a constructive manner. Business mediation is a structured, voluntary procedure that is designed to resolve conflicts. It gives the parties an opportunity to achieve a better solution than that provided by the law or the courts. A business mediator assumes the roles of an impartial moderator who helps the parties agree on a solution. The outcome of business mediation is always open – the procedure is based on a high degree of confidentiality and willingness on the part of the parties to shoulder a high level of responsibility.

THE KEY STEPS IN MEDIATION PROCEEDINGS

After a preparatory discussion and after an initial list of issues has been drawn up, the parties comprehensively describe their view of the conflict. The business mediator then considers the needs and interests of the parties in order to increase their mutual understanding, raise their willingness to cooperate and create the largest possible scope for an agreement. The next step is to seek creative ideas to develop options aimed at resolving the areas of conflict. These options are assessed after the process of looking for ideas has ended and the best solutions are selected jointly. Every business mediation ends with a written agreement to settle the conflict.

MEDIATION ADVICE FOR INDIVIDUALS

Besides business mediation, we also offer personal advice as mediators. We aim to help you clarify a certain issue or conflict individually – regardless of other participants. This individual advice helps you recognise and reflect on your own role, intentions and actions and serves to develop new options.

In an initial interview, we clarify the framework and objectives. In other words, we determine what this mediation service is supposed to achieve and whether the objectives are realistic. In further talks, a detailed list of issues is drawn up and the specific problem or concern is named. We then clarify your interests and explore inner motives (e.g. why is that important? What would change?). On the basis of the talks conducted till then, potential solutions are outlined, one idea is selected and the resultant steps are then agreed and recorded.
